By purchasing, accessing, viewing, downloading, or using any products, courses, videos, documents, training materials, educational programs, digital downloads, or other content provided by Clear Thinking Institute ("Company," "we," "our," or "us"), you agree to be legally bound by these Terms & Conditions.
If you do not agree to these Terms, you may not access or use the content or services.
All products sold by the Company are digital educational materials and intellectual property delivered electronically.
Products may include:
• Video training programs
• Downloadable documents
• Educational modules
• Audio recordings
• Graphics and presentations
• Proprietary frameworks and methodologies
• Member access portals
• Digital learning experiences
All purchases are currently structured as one-time purchases unless explicitly stated otherwise at checkout. The Company is not a subscription service unless specifically identified as such in writing.
All content, materials, branding, systems, frameworks, graphics, videos, audio, written materials, and methodologies are protected by copyright, trademark, trade secret, and intellectual property laws.
Purchasing content grants the purchaser a limited, non-transferable, revocable license for personal use only.
You may NOT:
• Copy or reproduce materials
• Record or redistribute videos
• Share login credentials
• Upload content to file-sharing sites
• Republish Company content
• Train AI systems or language models using Company materials
• Sell, sublicense, or commercially exploit any portion of the content
• Create derivative works based upon Company materials
Unauthorized use constitutes theft of intellectual property and may result in:
• Immediate termination of access
• Permanent banning from Company systems
• Legal action
• Claims for monetary damages
• Recovery of attorney fees and costs where permitted by law
Due to the digital nature of the products and the immediate access to proprietary intellectual property, all sales are generally final.
Once any of the following occurs:
• Content has been accessed,
• Login credentials have been used,
• Videos have been viewed,
• Materials have been downloaded,
• Any portion of the program has been consumed,
the Company considers the product delivered and materially consumed.
Because digital educational products cannot be "returned" once accessed, refunds are not guaranteed and are issued solely at the Company's discretion.
Attempts to consume substantial portions of the content and subsequently request a refund may be considered abuse of the refund policy.
The Company reserves the right to deny any refund request where there is evidence of:
• Significant content consumption,
• Downloading or retention of materials,
• Intellectual property misuse,
• Fraudulent activity,
• Chargeback abuse,
• Content copying or sharing.
By purchasing from the Company, you agree not to initiate fraudulent or abusive chargebacks.
If a chargeback is initiated after access to content has been granted, the Company reserves the right to:
• Revoke all access immediately,
• Permanently ban the purchaser,
• Submit evidence of access and usage to payment processors,
• Pursue recovery of damages, fees, and costs associated with the dispute.
Platform usage records, login history, video engagement analytics, IP records, download logs, and account activity may be used as evidence in resolving disputes.
In the event of any dispute, claim, refund disagreement, or controversy arising from or relating to the purchase or use of Company products or services, the parties agree to first attempt to resolve the matter through informal good-faith discussions.
If unresolved, the dispute shall proceed to confidential mediation before any legal proceeding may be initiated.
If mediation does not resolve the dispute, the matter shall be resolved exclusively through binding arbitration rather than litigation in court.
Arbitration shall:
• Be conducted in the State of Florida,
• Be governed by Florida law,
• Be handled by a mutually agreed arbitration service,
• Be conducted on an individual basis only.
You waive any right to:
• Jury trial,
• Class action participation,
• Class arbitration,
• Collective claims against the Company.
Each party shall bear its own legal fees unless otherwise awarded by the arbitrator.
The Company provides educational and informational content only.
We make no guarantees regarding:
• Personal results,
• Business outcomes,
• Financial outcomes,
• Emotional or psychological outcomes,
• Career advancement,
• Individual performance improvements.
To the fullest extent permitted by law, the Company shall not be liable for:
• Indirect damages,
• Consequential damages,
• Lost profits,
• Business interruption,
• Emotional distress,
• Data loss,
• Reliance on educational content.
Total liability for any claim shall not exceed the amount actually paid by the purchaser for the specific product in dispute.
The Company reserves the right to suspend or terminate access without refund if a user:
• Violates these Terms,
• Shares access credentials,
• Copies or redistributes materials,
• Harasses staff or users,
• Attempts unauthorized access,
• Engages in fraudulent behavior,
• Misuses Company intellectual property.
The Company reserves the right to modify these Terms at any time.
Updated Terms become effective upon posting to the website.
Continued use of Company products or services constitutes acceptance of revised Terms.
These Terms shall be governed and interpreted under the laws of the State of Florida, without regard to conflict of law principles.
